Beppe Grillo committed itself not to promote “any dispute” against the 5 Star Movement regarding the use of the name and symbol, even if in the future the logo is modified “in whole or in part”. Like the confrontation between Grillo and Giuseppe ConteAdnkronos took possession of the private agreement stipulated between Elevato and the 5 Star Movement, where the Genoese comedian’s commitment not to take legal action regarding the use of the symbol by M5S is written in black and white. Both Conte and the Movement’s notary spoke about this document, Alfonso Colucciin several interviews.
But the paper that effectively “locks” the five-star symbol in the Via Campo Marzio trunk was never disclosed. The document is certainly from after 2021, given the reference to the national headquarters of Campo Marzio that was installed there that year. But the precise date of writing is confidential and covered by omission in the version that Adnkronos obtained.
In the private agreement, reference is made to the “compensation” guaranteed by the Movement, which exempts Grillo from the financial consequences arising from possible legal proceedings. In exchange for this type of legal protection, the Almighty is obliged to make a series of “commitments”. In detail, we read on page 14 of the document seen by Adnkronos, Grillo is obliged “not to formulate on his own and as legal representative of the associations” M5S of 2009 and 2012 “any objection” against the Associação Movimento 5 Estrelas 2017 (i.e. the one chaired by Conte) “with regard to the use of the name 5 Star Movement and/or the symbol” described in the introduction, as well as the symbol “as modified heretofore and as may be modified in the future, in whole or in part”, by M5S.
But that’s not all. Grillo also undertakes “not to provide functional and/or structural collaboration to other associations whose objective is to carry out activities in conflict and/or competition” with the Movement: essentially, if a split occurs or a new one emerges, an antithetical pro-Grillina political force to Conte’s Movement, Beppe Grillo would not be able to work with or for this new formation. Point 6 of the document reveals the temporal extension of the agreement. “This contract – we read – has no deadline” and will only be resolved with the dissolution of the 5 Star Movement Association based in Rome at Via di Campo Marzio n. 46. In this case, “the compensation will take effect only in relation to disputes arising within 5 years from the date of its dissolution”, without prejudice to the effects “of the 2018 compensation”.
